Professional Sportsmen & sexual consent ..( Rape)

Benjamin Mendy is up for 4 counts of Rape. Lets not dwell on the details of a live legal courtcase.

Do not discuss Mendy, but just the general themes of the Thread title.


however, footballers do seem to often get accused of rape.

Mike Tyson got convicted of raping a woman who had followed him to his hotel room , and entered the bedroom he was wandering around in his underpants. And Tyson went to jail.

On the one hand, Rape is a heinous crime and deserves the bloody book of Law. On the other hand, why do so many elite sportsmen seem to get accused of Rape ?

Should a judge regard a footballer with a previously Saintly character different to somebody with a Marlon King rap-sheet ?

Being a lady becky, what's your take. Could these be 4 women who have all been used and want revenge. I hope they have more than just a few crocodile tears and empty purses if it's the case.

Haven't read all the details so wouldn't actually condemn anyone either way in this case, but it has been known to happen.

On one hand so few of those accused of rape are actually found guilty (because it's he said, she said) that clearly there are rapists getting away with it.

On the other hand as Becky rightly states, accusing someone of rape due to being scorned or obsessive is something of a no consequence freebie, and the only person's life ruined is the accused.

It doesn't seem right to me that only he was named but as he has been, guilt is assumed by default, sponsorship dries up, the works. I will say that it certainly doesn't look good that there are three complainants, but at the same time am far from keen on the idea that potentially, in a general sense rather than this case specifically, on a whim an accuser can decide to ruin a persons life, and society just goes with it.

If the sportsperson has done this then they go to prison as a serial rapist for a long time and rightly so. On the other hand if this is just women scorned and can be proved then they deserve to be publicly humiliated and have their anonymity stripped. Mud sticks and this Man City player will always be known as a rapist regardless of guilt.

I know they decided that anonymity for the accuser and naming the accused would encourage more women to come forward and address the problems of unreported rape cases, especially, as in this case, where there is more than one women involved.

As pointed out though, this generally ruins the life of the accused (another sort of 'trial by medial') so, regardless, it either should be names of both/all or names of none, this would also eradicate any possibility of a 'career accuser'.

Anonymity for both accused and accuser should be left to the trial judge.

Plenty of women are raped but there is a lack of evidence to convict so they should not be named.

It's a tricky call which is best left to individual court cases.

As for perjury the convicted should serve the sentence that the innocent person they lied about would have e.g. rape 7 years, murder 20 years.

..are these women confusing a one-night stand with a marriage proposal ? To net an Elite sportsman could be like winning the lottery ? Is Messi more at risk of a rape allegation than the bloke who washes dishes at your local cafe ?

but as mentioned above, sportsmen have a very high libido. So do they struggle to control their urges ?

didn't some IT fella invent a 'consent App' to go onto your mobile phone ? And basically no bedroom action until both parties tick the electronic box. Giving the footballer some protection in a Court of Law.

If i was a football manager, i would insist all my single young men had such an App on their phone to protect them from rape allegations from predatory women.

And for the sake of balance, surely any Footballer with a criminal record (for any crime) should not be given access to the fantasy wonderland of Elite sport ? The Marlon Kings of this World are not welcome here - regardless of how good they are at kicking a ball.

Probably not confusing a one night stand with a proposal,but, yes, maybe expecting something longer term to come out of it, as in feeling 'special' to have been chatted up by someone famous, confusing lust for attraction?

On the other side of the coin, back in the 60's, it was not unknown for certain women to 'collect' notches on their (or the other persons') bedpost from sleeping with a celebrity - bragging rights with their friends as to how many famous people they had caught the eye of. Maybe, to an extent this still goes on, which is why celebrities, whether sportsmen, singers,musicians et al are always more at risk than refuse collectors and plumbers (and they're richer too if you're the kiss and tell or kiss and sue type).

I agree about the app though - even if it does make it all a bit clinical, it would certainly prevent later false claims!

..and then there is the conundrum of people's ability to give real sexual consent when they are blind drunk.

the irony being that so many first sexual encounters occur among drunken strangers.
