Forest Hillbilly in a hidey-hole 21 May 14 7.36am | |

Quite a few ladies have testified so far. I would have thought this could have been dismissed as collusion a few years ago (what with no evidence: photos, DNA, witness accounts) However, after Max Clifford being banged-up on a few victims testimonies, I would have to say that I also think Rolf will be spending time at her Majesties leasure,..and this time he won't be portrait painting her. Is it just me, but when you see the 'artists impression' of the courtroom drama, Do you think ,"I wonder if Rolf could have done it better than that ?"

Has been charged with nine counts of indecent assault and four of making indecent images of children, alleged to have been made last year.
Is it doctoring pictures, drawing things, taking photos or all of the above? No rofl for Rolf anyway. I remember hearing somewhere they wanted to change the law to extend that charge to include bringing the image up on your screen, which I guess is technically the case as it's only bytes of data before it becomes pixels. This may have been on Brasseye though. I think it requires that you either record or pass on such data, such as making it available to others. It would be difficult to establish Actus or Mens Rae just because you viewed such material (it could easily be argued to be accidental or none deliberate). Showing deliberation and intention is generally required for a criminal case, along with knowledge of what you were doing. It is however important that the UK avoids becoming like the US, where the convenience of sexual offences becomes used as a means of moral crusading (where you have people on the sex offenders register for urinating in a public place - as indecent exposure) - Punitive agendas don't really serve the best interests of society when the stray from protection of the vulnerable, to a means of establishing convictions. Likewise, if a 15 year old sends you nude pictures of herself you could be argued to have committed an offence, even if you reported the offence. Its important to retain a perspective. Similarly, if an artist paints a picture of a nude child, is it 'making images', if the pursuit is artistic rather than for gratification? That would depend on who's spunk and blood the artist uses as 'materials'
