She suggests this decision has the potential to turn any President, even Biden, into a dictator. No one, whichever side of politics you are on should tolerate that. Biden could now order Trump to be killed and nothing legally would happen. This opens the door to a dictatorship. Congress now needs to urgently legislate to overturn this ruling. In the immediate future this makes it even more important to ensure Trump does not succeed. I expect it to become the main topic of their campaign and for the spectre of Trump as a dictator to now be centre stage. Biden must, and will, now stand aside. I can imagine quite a few Republican members and Senators who aren’t just Trump bootlickers being openly concerned as well. It’s a dark day for democracy and the western world. It's a dissenting opinion which her fellow judges don't share. Trump does not have the green light to do what he likes with impunity. The Federal Court can still hold Trump to account but first they have to shift the chaff from the wheat. The SC does not stop lower courts from prosecuting but has given them guidelines as to how the SC will judge any case that comes to them. Ordering an inquiry into allegations of Election fraud should not be an offence.

If you have read the majority ruling they have gone a lot further than simply stating that he cannot be prosecuted for ordering an enquiry into election fraud, or events only concerned with official duties. They have specified things like conversations with Pence about not authenticating the result. Which concern only the election result which had been confirmed by the officials responsible. Hopefully a lower Court will rule that something like asking a Governor to “find” some votes falls outside the ruling and that the recording exists outside the official records, because they have all been ruled inadmissible. Notwithstanding any of that what this has certainly done is add another field of long grass to wade through before we get this man in front of another jury. By which time he will hope to be in a position to sack the prosecutor. It’s unreal! Let’s hope some way can be found to stop this nightmare. Prosecuting afterwards being much less important than ensuring he isn’t in the WH.

In a less talked about decision from the Supreme Court on the same day it found that the DoJ had over charged Jan 6th individuals. Another push back against a politicalised DoJ by the highest court in the land.

When Obama was still President he politely suggested that now would be a good time to retire so he could appoint a younger version of herself just in case the Republicans got in. Even back then Ginsberg had been plagued with serious health issues so it was obvious she would have to step down soon. She ignored his request so it's on her if she didn't like her replacement.
