Or, to simplify the issue (Midlands Eagle please note): Because murder is generally defined in law as an intent to cause serious harm or injury (alone or with others), combined with a death arising from that intention, there are certain circumstances where a death will be treated as murder even if the defendant did not wish to kill the actual victim. This is called "transferred malice", and arises in two common cases:

Ah, the daily YT jibe again. I hope that you thanked Owen for providing you with the evidence to have yet another dig at me I don't have a dog in your fight, I was just curious to see what the current legal in interpretation is.
Responsibility Deficit Disorder is a medical condition. Symptoms include inability to be corrected when wrong, false sense of superiority, desire to share personal info no else cares about, general hubris. It's a medical issue rather than pure arrogance. |

Ah, the daily YT jibe again. I hope that you thanked Owen for providing you with the evidence to have yet another dig at me Sorry if you took it as a jibe. I was merely trying to highlight to that you were incorrect in your interpretation about what can't be classed as murder i.e. this particular killing.

I now challenge you to google his name next week, or the week after ......and see how many new news articles are being written about him. Many other murders are long forgotten, the victims ( and killers) now all anonymous to Joe Public.

O.T.but that reminds me, haven't heard anything about Madeline McCann this year -no new funding for the investigation following up important NEW evidence/suspects.......sign of the hard financial times maybe?

Agreed. A couple of years back I heard the funding was due to finish in the spring so I predicted there would be new media reports about a suspect they were just about to arrest and lo and behold come spring that's what happened. It is a tragedy what happened to that poor girl but the truth is until they find a body there is no critical evidence that can put a suspect away. Several people have been named as being near the resort but that is like saying a pedophile lives 500 yards from a school in London. The truth is that most people live 500 yards from a school in urban areas it's harder not to. Just because the German police have a pedophile in their sights it doesn't mean he did it or more importantly they can prove it. The UK police have spent a fortune on this it's time to put it in the cold case file until a body turns up. You have to wonder with no new leads what the officers assigned to the case do all day.
