The real influence of the next President will be that they will get to nominate at least one, and probably two, justices to the Supreme Court. Bush Jr. got to put two on there, and he chose very young and very conservative judges. Obama got to put two on there, and he chose two very young and very liberal judges.

Whoever gets to choose the next two, will establish the political slant of the court for the next generation.

Good couple of posts. Glad to hear that even those who can vote think that it's a very strange system you've got.

Didn't Obama make it 4-3 in favour of liberal judges? Even that's a strange one to me though, they get the job until they die don't they?

I would've thought a fixed term for each one would be better. And stagger the end of terms.

The Supreme Court is 9 justices with lifetime appointments. After Obama's "appointments" (technically, the President merely nominates a candidate who is then confirmed by the Senate), the court was considered split: 4 conservatives (Roberts, Scalia, Alito and Thomas), 4 liberals (Bader-Ginsburg, Sotamayor, Kagen and Breyer) and 1 swinger (Kennedy). This is why almost everything was coming out to a 5/4 decision, which is binding regardless of the slim majority.

A few months ago, Scalia died unexpectedly, leaving only 8 justices. The Republican-lead Senate has refused to confirm Obama's nominee (a bluff-call nomination of a candidate mooted as acceptable previously by Republicans), so the seat sits empty. Currently, therefore, conservatives can force a tie with the support of Kennedy, but can't achieve a majority (a tie means the lower court's decision stands).

Obama's nominee is likely to be in the Kennedy "swinger" mode, so their refusal to even interview the guy is either politically ballsy or politically cowardly, depending on your thoughts on the motivation. Either they're waiting for President Trump to nominate a conservative despite his dire prospects in November, or they're too scared of being branded a traitor by their own party for helping Obama seat another justice. Either way, the next President gets to nominate their own choice.

Given Trump's strong penchant for nepotism, don't be surprised if he nominates his sister - a senior appeals court judge.

I would add to his failures, the total lack of progress in the banning of bandanas.
