1. U're in Shakespeare class, James, did not know u had that in u. Thanks, appreciated (you did know I write books and am a published author didn't you?). Took me five minutes from start to finish but I never bothered to check it! I really do believe this is going to come back and bite Cardiff on the backside. Had Cardiff won Tan would be giving it large about how we knew their team and they still beat us - but he would not be making complaints.

I haven't read all the posts so this point may have been mentioned! If it is true that Cardiff knew about this insider information leak before the game and they seriously believed it was going to impact the game then why did they not raise the issue and get the game postponed. Of course they didn't as they expected to win and it is trivial. However to raise the issue retrospectively now contradicts themselves as if they truly think it serious they should have reported it before the game. In business to know of insider dealing and not report it is equally as guilty and penalised as the persos who act on the insider information......... I say Cardiff to be relegated to the Welsh League where they belong

"League chiefs will decide whether the complaint should be taken forward - it is understood there remains uncertainty about whether any regulation would have been breached even if the allegation was proven." - BBC Sport The point here is that cardiff would have to have some pretty solid evidence and even if they did it's not clear if any rules have been breached. Also on the Beeb TP has stated quite clearly that: "I log every session that I do and I'll show that I picked my team on the Monday before". So given that he fielded the same starting XI that beat Chelsea this clearly is a storm in a teacup.
And I see signs of half remembered days, I hear bells that chime in strange familiar ways |

The only punishments than can be handed out would be to individuals and not the club. If our board instructed Moody to do what he has supposedly done, then if there are rules broken we could be liable. I very much doubt this is the case though. The are only two instances of Prem teams being docked points, Pompey for their administration and Borough for failing to fulfill a fixture, in both instances the ownership of both clubs were involved. What can they do? confiscate Moody's phone. Storm in a tan cup.

Been thinking more about this. Any solicitors or barristers on here please correct me. It seems to me that Freedman only had the responsibility to raise the issue if it appeared something criminal had been undertaken. In any case that is surely the first point, did Moody do something criminal in which case the Courts would have jurisdiction. Assuming he did not, it looks possible he is in breach of his Settlement Agreement. In that case, if what has been said earlier in this thread is correct, Cardiff can take him to civil court and I would think the Premier League couldn't stop an employer taking its ex employee to court. So the next threshold to cross is to prove he breached his confidentiality or non-compete clause(s). If that is done successfully, I would expect Cardiff to be able to reclaim what was paid to Moody in his Settlement Agreement, especially as he probably mitigated much of his loss when he left Cardiff as he joined Palace pretty quickly. I would also expect Cardiff to try to obtain damages. Here there would be a big burden of proving the loss and I doubt they would have any success. Presumably Cardiff can't join Palace to any civil case as it says above that one Premier team can't sue another. So then the Premier League has to act in place of the courts. If Cardiff can prove a wrong and prove the amount of loss suffered, the Premier League may then take some action. Many hills to climb before getting to that point and it's arguable they suffered no loss at all. I can't for one minute believe the Premier League would impute that Cardiff would have won had none of this happened, so I just don't see a points deduction or a replay. Maybe a fine to slap us on the wrist and some small damages to Cardiff for the hassle factor. Edited by Mapletree (19 Apr 2014 10.47am)
