Mike Tyson did jail time for a rape. His accuser willingly followed him to his hotel bedroom and entered the room having seen Tyson lying on the bed in his underpants. as discussed above, women have the right to remove their consent. Even after penetration. Frustrating but true. however, the legality of Rape allegations will probably always be a minefield. What is the Law in Saudi about rape ? is it that the rape must be witnessed by men or something ? in order to stand up in a court of law ? in my personal opinion, the victim reports the rape within 24 hours or its null & void. I mean, imagine reporting a car crash after 4 years have elapsed ? Brand is certainly an unsavoury sleazy character. But i get the smell of something rotten in Denmark. Edited by PalazioVecchio (25 Sep 2023 11.38am) I get the point entirely, but there are cases where women have been held captive for weeks, months and years. There would have to be good reason why DNA evidence wasn't gathered, or the offence reported.
I disengage, I turn the page. |

Edited by PalazioVecchio (25 Sep 2023 11.38am) I think there is a sound argument for putting a time limit on minor offences including sexual offences e.g. he touched my bottom. This stuff is a waste of police time as it is highly unlikely that there will be any evidence beyond the witness complaint. However there should not be a time limit on serious stuff e.g. rape or murder. As for the time limit I would say something like 4-6 years.

to some people, making allegations is 'evidence' Not that I am aware of. A series of allegations made by people without prior knowledge of the others could be regarded as circumstantial evidence but how much weight would be attached would be up to a jury to decide.

I'm not sure how you've deduced that or why you've decided to personalise a fairly inoffensive opinion. Age gaps obviously become progressively less problematic the older you get, and broadly when all parties are adults (ie. over 1 I don't think the law should bother itself with who you shag, as long as it's all consensual. You and your wife were both in your 20s when you met - it's nothing like what I'm describing.

That can happen, but it also opens up the charge to misuse....which I believe is happening more often in today's culture. I would agree on a time limit of three months, unless there are exceptional circumstances. Though the problem with rape is that the nature of the crime is far harder to prove than murder. You and your wife were both in your 20s when you met - it's nothing like what I'm describing. So you think the age of consent should be raised to 18? I wouldn't be against that, however I can see problems that it creates as it's difficult enough now with a significant number of 16 year olds having sex before it's legal. It's roughly around 1 in 3. When we look at why the answer is obvious....it's both cultural and technological. Cultural insomuch as social liberalism encourages sexuality and sexual freedom and technological down to the reality of the pill and the removal of social stigma. The statistics from the link showing that in 1964 the number of teenagers reporting underage sex being a least half what it was since these cultural and technological changes. I don't know what the solution is (even social conservatism would only be a partial answer).....I'd like a solution but I don't think it's going to be under social liberalism. You can raise the age of consent to any age you like....unless you change the culture it makes no difference and while the pill is there....nothing will change. It's circumstantial evidence.....which can be useful but on its own needs more. We just convicted Letby largely on statistical circumstantial evidence...but importantly not only that....the note and autopsies were important. There are nuances, there are many dark aspects to this area that people don't like to think about. Hell, I don't like to think about them but if we had to address the area seriously those aspects are there to be considered.
