There was a date rape case involving 2 students. The victim agreed that she willingly went back to his flat stripped naked and took part in mutual oral sex (69). However when he penetrated her she withdraw consent. The jury rightly in my opinion decided it wasn't rape. Lawyers and politicians can argue about how many angels there are on a pin head but a jury will use commonsense when deciding if a person consented or not. It has been suggested that people should sign consent forms but that wont work either as a victim can argue that they withdraw consent after signing the form. It's a minefield with no easy answers. Edited by Badger11 (21 Sep 2023 4.53pm) It certainly isn’t easy but perhaps a case resulting from this might clarify things and provide guidelines as to where the boundaries lie. I think myself that it’s possible to define some clearly understood, common sense general principles.

The fact so many of their tapes end up in the public domain is purely coincidental.

He has replied, hasn't he? He's said that he's done nothing illegal. You (and many others) assume that anyone who is wrongly accused of something must inevitably instruct m'learned friends. Do you have any idea how much it costs to sue the likes of The Times and Channel 4? Millions. Then months and months of legal process, with no certainty of a good outcome and - as I pointed out to Wisbech, but inevitably he knew better - damages in UK defamation cases are notoriously low. A far more pragmatic - and realistic - approach would be to continue to deny all accusations and say "so sue me" or "so charge me". If we take the position that Brand is innocent then if I had to give advice....obviously being a complete layman....but nevertheless....I'd advise him against going to the courts. Our justice system is inherently liberalised and full of 'right ons'.....We only have to look at what happened to Johnny Depp here to see that. He would probably be wasting a huge chunk of his money.

And as I've said previously, our legal system clearly struggles to achieve convictions in this space - I don't have anywhere near the confidence others seem to in it. I am aged 30 currently and the thought of me, or any of my friends, shagging a 16 year old is absolutely disgusting. If one of my mates shared with the group he'd shagged a 16 year old, it would not go down well with anyone - I'm amazed you think that's normal, frankly. It's an adult and a child and should undoubtedly be illegal. You clearly do think it's appropriate to ask absurd questions given your first contribution was to suggest someone claiming to be a victim of sexual assault should be asked "did you enjoy it?" on a national radio show. How do you think the 'genuine' victims of abuse and rape feel when people like you tie yourself in knots to disbelieve every story that comes forward of this type of thing? You are also ignoring the numerous other allegations against Brand from numerous women - have you watched the Dispatches show? I thought I made it quite clear I was not. I was referring to the one isolated case. And a question as clearly times have changed. You and all your friends would never have sex with anyone under 30, 26, 22...

Responsibility Deficit Disorder is a medical condition. Symptoms include inability to be corrected when wrong, false sense of superiority, desire to share personal info no else cares about, general hubris. It's a medical issue rather than pure arrogance. |

Perhaps at the end of the day Russell Brand just thought that the 'MeToo' movement was a threesome invite. Live by the d1ck, die by the d1ck. Mmmm...suitable perhaps for this case but I could see that quote losing favour in the Pride movement. Edited by Stirlingsays (22 Sep 2023 2.22am)

One theory I have heard is that he is actually quite popular with women (irony upon irony) in terms of his political output. And that the powers-that-be who manipulate public opinion fear him because of that. Essentially women are far more likely to buy into all kinds of progressive BS than men. With Brand seen as a potential threat to that hence this attempt to knock him out of the game. Not 100% convinced but then again, I never got the entire schtick of him anyway and none of the women in my life ever paid him or his antics the slightest bit of interest either but perhaps there might be something to that? Not sad enough to check up the demographics of his current audience. Because otherwise, he remains a huge puzzle as to why he is now the target of this kind of level of interest? He was/is yesterdays man. Or maybe he is just a warning to other people who were previously mainstream and, at least politically, on-board with the Zeitgeist not to jump ship because this is what will happen to them? You are being ridiculous again. Of course I accept that people can be identified by their names and their photographs. What I don’t accept is that you can determine anyone’s ethnicity just by reading a name or looking at a photograph. For most people you are correct but with my employment background I believe I could establish the ethnicity of many people just by looking at them ( or even by their name) so it is not impossible

Edited by HKOwen (22 Sep 2023 12.07am) I guess this refers to some offhand remarks I made about the influx of overseas health workers at our local hospital. A hospital where my wife works and when she does I generally drop her off and pick her up, as I did this morning. I know from her, from the reports in the local press and my own interactions with the staff there that the hospital has, and continues to, fill a lot of vacancies from overseas. Primarily from a variety of African nations, India and the Philippines. Any remarks I would have made would have been in that context. Of course I cannot be sure just by looking at any individual whether they are newly arrived, been here for years or born here. What I can be sure of is that there are increasing numbers of overseas workers in our local hospital. That is factual. It has nothing to do with looking at anybody in the street, even if the streets around the hospital provide plenty of circumstantial evidence. Why anyone is so desperate to try to find holes in anything I say is a very sad phenomenon to witness.

I can tell a Filipino from a Thai by their dress and mannerisms even though they are both Malay. On holiday recently I fell into conversation with a couple who by appearance and accent I thought came from the Netherlands. They are Russian, having spent many years living in the USA!
