Clearly do the sensible thing and check before then getting to the roots on your side of the fence and cutting them away before then dropping poison in and around them before covering back up.

I wouldn't kill somebody else's tree but I would say that their behaviour is inconsiderate and is causing you inconvenience. Maybe there is some official 'root' you can go down because this kind of thing must have happened many a time before.
