Excellent point. In retrospect I totally should've.

But at the time, they weren't my tickets. I didn't have them in hand (never did) and I was out the money. He was in control of both. SO how was I to sell tickets I couldn't transfer or even had the rights to sell? Upon receipt of the money, the tickets never came to me. So not sure how I was going to sell something I didn't have in my possession.

I would then respectfully point you towards the title of your post, buyer beware. You paid for something you had not taken title or receipt of already.

I would suggest that you put this down to experience, however, given another members post you will probably get your money back eventually, because we are not a bad bunch on here.

You probably know Jack Schitt about Palace, you have been on here for four months and posted half a dozen times, initially only on the ticket thread because you wanted tickets to the Man City game because your bird played for a Uni team in the arse end of the US.

I doubt the seller intended to see you lose out, so just accept it was your mistake

The title perfectly summarizes my experience from transacting with Declansmith. As one poster alluded to, it was a stressful experience and they thought they had been taken for, but in the end they came through. However, in the future, they would refrain from conducting business with the individual.

Caveat Emptor.

The axiom or principle in commerce that the buyer alone is responsible for assessing the quality of a purchase before buying.

Everyone has the ability to decide for themselves.

I'm responsible for my actions. I'm trying to let others know of my experience so they can make their own decisions in the future.

I never said the group over here was a bad bunch. Had I not posted this in a public setting, I wouldn't have even known about the other posters experience would I?

If you want characterize me based on my online activity that you've pieced together a la Sherlock Holmes and pretend to think you've got me figured out, that says more about you than it does me.

Thanks Qeeb12 and Tom. I'll never buy from Declansmith now and it speaks volumes that the mods approved Qeeb12's post.

From reading this I think it's fair to say that Qeeb12 should have had those tickets. In this kind of transaction I don't think there really should be an obligation to a refund but they should have been this guy's right to sell on.

Although it's not the responsibility of either the site or the mods we did ask Declan Smith to refund the money and we got the run around too with promises made and not kept.

Smith provided neither the tickets nor the money which in my book amounts to dishonesty.

I agree with your comment about cb1969 as his comments are daft and irrelevant

I disagree. I have bought from Declan a couple of times when i wanted to bring more family members to matches, and while there were bumps along the way including getting my tickets the day before the match on one occaision. I always got what i was promised at the price we agreed. He is not dishonest.

I do agree that sometimes his communication is patchy though. But to say buyer beware is not fair.

I have no skin in the game other than putting the point across that Declan sold me tickets in an honest and fair way. Sorry you had a problem with him Qeeb - hope you get to see palace next season..

Thanks for taking the time to reply. I'm glad to hear that you had a good experience.

That in itself gives me some hope of reaching a resolution with Declansmith. I'll post an update in the event I hear back.

And yes, we both thoroughly enjoyed our visit to London. We will absolutely come and visit again, and hopefully align it with a Palace home game!!

Your experience does not alter the facts that Qeeb12 received neither the tickets nor a refund and, in anyone's book, that IS dishonest. The last communication I had from Declansmith was an assurance that a refund would be made on 18 April "100%", which was the latest in a long line of prevarication over a period of months. I have received no response from him to my request for an explanation as to why his latest assurance of a refund hasn't been met and I do not hold out any hope of receiving one. Notwithstanding anyone's previous experiences with this individual, I do not wish to see any other HOL members placed in the position of being £50 out of pocket.

Actually yes it does. Along with several others on here who have bought tickets from Declan. General concensus is things can get a bit patchy but the tickets are delivered. He sells tickets for loads of games and I haven't seen any other complaints.

You believe him to be dishonest, I have bought from him twice this season (Spurs and Newcastle, although both games were so bad I wish I hadn't! ) and believe him to be honest and would buy from him again. These are not facts - this is your belief and my belief, both based on experiences, therefore both valid.

This is a peer to peer transaction that went wrong. I'm sure matey will get his money back and think calling a guy out in public is a bit much.

Thanks

Attempting to defend the indefensible makes you look a fool as does calling someone with a legitimate complaint "matey". Unless Declansmith resolves this issue now he won't be given any futher opportunities to trade tickets on this site.

I'm sure you're aware this is available to you, but just in case, take a look at the international members option the club offers.

There's no way I would rely on other HOL members for tickets when flying in from another country.
