Slightly different outcome, but I remember my dad telling me about his mate cementing broken glass on top of his wall to keep out the scrotes and being told off by the local PC. His mate's reasoning was the same though, if you don't try and break in, you won't get hurt. If you get hurt, that's your fault. If someone broke into my house, cornered me with a weapon - especially one that could be used to stab - I would like to think I'd grab, and use, a knife - or similar. Using your own weapon should surely fall into the category of 'reasonable force though. Edited by Charlie Croker (04 Apr 2018 2.28pm)

Reality is not like that, and if I, my home, or my family are threatened by more than one assailant, I'm not going to let up on person #1 until I'm bloody sure he's not getting up (ideally because he's incapacitated, but I'm afraid I can't guarantee that incapacitation wouldn't be permanent). The last thing you want to do is to not go far enough, and end up still facing 2 assailants, one who now has a bloody nose, and a sense of indignation!

Right that he is arrested and the due process is followed while the events are established, and it will also be right that if he was indeed defending himself within reasonable force against assailants that he isn’t charged with anything. It’s too soon to say for sure but from the sounds of it he did nothing wrong and was defending himself against intruders threatening him with a screwdriver in his own home.

Not sure I agree with this. How about the police do their due process and if any evidence points to his guilt then arrest him? He is 78yo man unless the police have knowledge that he is a flight risk he is not going anywhere. This wasn't a street fight. I would have taken him to the station got a statement and then released him pending enquiries. So unless he told the coppers at the scene that he was guilty I am surprised.

Great work by the old guy. The arrest could be routine, questioning him would be reasonable given the circumstances but hopefully they will let him go soon and the process won't be traumatic for him. The "victim" would not show anyone he burgled any sympathy and deserves none of the protection society offers its law abiding citizens. As someone mentioned earlier, there doesnt appear to be any comparison with the Tony Martin case. He shot his burglar in the back from distance whilst he was running away. He had a history of firearms offences. He'd have had to have unlocked a gun kept in one room, then a ammunition cabinet in another room, chased the guy, then shot him. Again, no sympathy for the victim, but he was a mad old reclusive farmer who was probably a danger to himself and society.

Violent burglaries are common in all parts of the country. You see horrifying reports of pensioners getting beaten up so bad , it basically ends their life. The scum that broke in probably thought it was another easy target. If they charge this hero, there will be an outcry as people have had enough. Hopefully his heroic actions may deter other scum, but sadly I doubt it.

This feels wrong to me in the sense of the guy defending himself and his property. I suspect the burglar with the screwdriver was not there to fix a loose shelf but I guess we have to wait for the full facts to emerge in order to understand why he has been charged.

[Link] They kicked and punched him until he was black and blue, and he had 3 other people in the house with him.

Not sure he has been charged. My understanding is that he was arrested for murder and its possible that the cops did that to ensure he took legal advice before being interviewed by them. If these burglars were unknown to him and entered the house armed with a screw driver, then it is difficult to imagine how any case could be brought against the man, especially given the disparity in ages but in this day and age, you simply have no idea about the insanity that infects our public services.

The old boy should NEVER be charged with murder! What a joke he was protecting himself and he’s property from two SCUMBAGS! One of them got what they were asking for!! Hopefully all of us would do the same thing!! What right have they GOT!! No sympathy whatsoever...
