Rubbish, that would see so many people in jail. This idea that 'perception' is more important that 'intent' isn't only dangerous rubbish but I view it as completely illiberal.

I didn't like the 'gas the jews' bit.....This guy likes bad taste jokes. You know what, so do some blokes down the pub.

However, when it gets to the point of court cases and even worse jail time......the state has gone very wrong.

This is not ok, something must be done.

I'm writing to my local MP at the very least. Here's a link to a video calling for action over this and the guy has written a template MP letter over it for people.

Just reminded me that a bloke got arrested for wearing an offensive t shirt in a pub a couple of years back. Something about Hillsborough IIRC.

I'm not disagreeing with the fact that free speech should be allowed, but unfortunately Youtube and the like have given people the platform to get across to the masses.
If you tell a bad taste joke down the pub the only person you will offend is the person you are telling. Now you might end up with a smack in the eye, but that is generally as far as it will go.
Now, recording yourself saying something as inflammatory as g*s the j**s and putting it on a public platform is, as I have said before, stupid to say the least.
The prison sentence is, again, as I have said before, overkill.
Maybe this guy is a genuine comic genius, and suffering for his art will make him a star.
Maybe it will just make other dumb people think twice before they put stuff online for all to see, yes I'm talking to you, the girl who shot her boyfriend through a yellow pages just to put something on Youtube.

I'm sorry mate, but no one makes you play his video on YouTube. He put a disclaimer on the video saying it was a joke....I throw my hands up at so called 'freedom of speech' defenders today....the 'but' mob.

As for violence and smacking him.....This was a bad taste joke for fcuk's sake. Whoever wants to be a big man and smack others for bad taste jokes then get down the pub and see how long you last. I'll be supporting the guys who hit back even if I don't like their jokes.

It was a very edgy joke but if you are sensitive then you don't have to watch the video.

He wasn't even convicted with inciting violence or anything, his crime was literally being offensive...he could get a year in jail for making an offensive joke. That's nuts. People get less for assault. Jesus.

You seem to think that I care about what this guy has done, as I have said before, I am not offended.
I was merely commenting on why I thought others would be offended, and suggested that sometimes people bring this upon themselves because they haven't really thought their actions through. Or maybe they have, and just don't give a f^^k about others.
People have to realise that there are sometimes consequences to their actions, and hiding behind freedom of speech isn't always an all encompassing shield.
As for the violence thing, I think you have misread my comment. I nowhere said I would smack someone, I just put out a theoretical scenario of what could happen 'down the pub'.

I may not conform to your beliefs, but I have an understanding of what is right and wrong, and I feel that this guy's comments are wrong, and he has, probably too harshly, been pulled on it.

Not ONE conviction for FGM (for example), yet a funny video on a comedy YouTube page gets a prison term. The Daily Mail was right; the judges ARE the enemies of the people.

This isn't a freedom of expression moment though is it, he wasn't putting forward a reasoned and well nuanced arguement ,there are no important truths or analysis being hidden by draconian government hell bent on supressing the righteous truth , what he has done is teach a dog to make nazi salutes on command.

In the summing up Sheriff O'Carroll said: "He said he chose 'gas the jews' as it was the most offensive phrase associated with the Nazi's that he could think of. It was the centrepiece of the joke. He said it was so extreme that it added to the comedy."

He was found guilt of by "means of a public electronic communications network a message or other matter that is grossly offensive or of an indecent, obscene or menacing character".

He understood it was offensive he knew it was public at the very least to paraphrase a football saying 'he has made the Judge have to make a decision on that'.

Being offensive is part of free speech! Comedy is finished if you can't cause offence. In the context, it was CLEARLY a joke and you must know that he wasn't organising a hate campaign against Jews. I mean, did you take the clip literally??

I don't think anyone is saying that he is some sort of hero but it absolutely is a free speech issue: offensive jokes can now be a criminal offence. On this basis many popular comedians should be up for long sentences.

This has been going through the courts for 2 years and must have cost the taxpayer hundreds of thousands in legal fees. It's ridiculous. The criminal justice systems was not set up for punishing offensive jokes.

Along similar lines, I'd be interesred to hear why the mods pulled my post today about Tottenham being Jewish, in the thread about Spurs making a derisory £40 millon bid for Zaha.

It was a joke ffs. That's all. The Jewish are known for being careful with their money.

If some poor little soul was offended by that then they need to either get a life or counselling.
