Not really, Actus Reus is a central concept in western law. It's a bit like applying common sense in law, you'd like it. Actus Reus and Mens Rae are both required for a criminal offence, otherwise there is no offence. Surely you mean 'mens rea', or are you just making it up. But back to the point, calling someone the 'n word' while shagging them is racist.

If a person wants to refer to someone else as "scum" and have their reasons for it, then that's their opinion which they are perfectly entitled to. does that same rule apply to the word c***?

Ops, yes, Mens Rae, actus reus would refer to the action, not the mind of the defendant. From Reds under the Bed, to reds in the bed. You do have a curious fixation. Yes, it could be racist, or it could be a fetish. I went out with a feminist who liked to be treated rough, and play out rape fantasy. Doesn't mean I'm a rapist. But I'd say, if someone says something potentially racist in private, and no one is offended, then no crime has been committed. Plenty of people like being insulted or degraded, or the use of offensive language during sex. Private lives are different to our public lives.

It's against the law to refer to someone as "scum"? Really? Not really, unless your trying to provoke them into committing a criminal act. Technically, insulting someone can be construed as verbal assault or disturbing the peace etc.

In that case, any alleged 'racist' comment made in any circumstance could be a fetish. As for the 'in private' point, what if it is said during a group-sex orgy, so not public!

Calling someone "scum" is not against the law! Who said anything about "hate speech"? Talk about moving the goalposts to fit your argument.
