As was pointed out to me this wasn't a jury trial, possibly for this very reason, but that's just a guess. It was decided by a Judge who would not be affected by anything other than the evidence. Where's your evidence for that? The fact is these are two judges appointed by the Attorney General, who is a standing Tory MP, to retry Robinson on completely different charges after the original ones were thrown out. That's the evidence for political persecution.

Judges are appointed by the Judicial Appointments Commission which is an independent body chaired by a layperson. The charge was still that he committed a contempt of Court offence. Why the wording was different is unknown to me, but I assume it might have been because of a need to avoid "doubly jeopardy" considerations! From all I read he was doing his best to get re-prosecuted by making political statements to the Judge etc. The AG concluded that it was in the public interest to bring fresh charges. That's not persecution. That's asking a Judge to decide if someone has committed a crime after they had been freed on a technicality. Persecution would only be a consideration if he had originally been found not guilty.
