If you’ve engaged in anything similar to what you hear and see in this case, I’d also suggest you should seek help. A quarter of straight p*** searches by women are for videos featuring violence against their own sex, Researchers found that 52 percent of the women had fantasies about forced sex with a man, 32 percent about being raped and 28 percent about forced oral sex with a man. Overall, 62 percent of the women reported having had at least one fantasy around a forced sex act. Seems a lot of women need help.

Yes, it's fair enough to state what, say, a defense may be from his perspective. He has his work cut out based on what's out there, but time will tell. I suspect his defence team are trawling through her past with a fine tooth comb as we speak.

Right, and the jump from a bit of bondage to those images and audio is enormous. ‘People like some weird s***’ is not a reasonable explanation for the evidence. Not even close to it. Never mind silly to rule it out, it’s pathetic to pretend it’s ruled in. I think the bloodied video clip, if that's blood, would be a bit extreme and unlikely and the audio clip doesn't really sound right for a rough sex defence...whereas the leg bruising could ..and consensual rough sex and the weird stuff does most definitely exist. It's legitimate for the Police to look into an extortion claim, if that's made. But like you I think most of us think that this is occam's razor and that he's essentially a rapey wrong un. Didn't a certain football get their rape conviction over turned because the appeal judge allowed the victim's previous sexual history to be taken into account. The only evidence that should be permitted is that related to the current incident.

For example, a rough or weird sex defence could be strengthened or weakened by the testimony of former boyfriends. Edited by Stirlingsays (02 Feb 2022 9.03am)

Edited by Stirlingsays (02 Feb 2022 9.03am) Perhaps but that is up to the judge, in the case I was thinking about I found the decision outrageous and irrelevant and for once I was on the side of the Wimmin.

I use to think of the justice system as something to be proud of but when you look into its past and indeed its present you see 'activist' judges, 'political' judges and all different types where it's sometimes much more of a lottery....I suppose that's why the jury system is there as a balance....but even that doesn't work sometimes as we saw with the 'statutes criminal damage' case recently. Being someone who is naturally conservative and only really interested in the truth of a matter rather than supporting a side it's all rather depressing. Edited by Stirlingsays (02 Feb 2022 9.21am)

I have jury service in a couple of weeks I am dreading it. I just hope we get open and shut cases and nothing with a touch of politics / racism. Otherwise I can see me sitting in the corner on my own with 11 others glowering at me.

Yes, it's important not to lurch from the lunacy of 'believe all women' to an equivalent in the other direction. One or two seem a bit perplexed at why she didn't just wander into a police station and say what happened, but really when there are fanciful lines of thought and get outs it makes it very clear why she documented and recorded. The video and audio in combination create very little room for explaining away. From the 'hacked' response from the family it could be perceived that she may not have had optimal support, so this was most likely a brief moment of bravery and cry for help. My concern would be that she could backtrack and underplay with far fetched 'roleplay' type explanations. I fully expect that they have her phone and other devices, as well as his and will be able to build a full picture of what is going on. I doubt it'll be a particularly pretty one. For one the amount of political type cases is radically overblown so it's unlikely anyway, and secondly if it is that kind of thing, then you just have to go with to go with what you think it fair and reasonable in the context of the facts (rather than aligned with this politics or that). It's unlikely you'd end up in a 'me against the world (or jury at least!) situation.
