What are your views on this scenario ? I put a deposit down on a new property (2K) to take property of market while my sale is going through .My sale collapses and last minute although was rushed through in quick time 5 weeks .I ask developer to give me a few more weeks to find buyer before he remarked property but he remarked straight away keeping my deposit until he finds another buyer or I pull out .I think this is totally wrong maybe illegal as my deposit was put down as to stop other viewings and hold while my property sold .But now he is using me as back up and stopping me from pulling out although was still interested if off market .But now I am kind of being blackmailed Thoughts ?

Get your solicitor on the case AERO. It does appear that the developer is pulling a fast one. I have no expertise, but I certainly wouldn't like to be in your position. Good luck mate.

Yes next step. He will only refund when he gets a buyer or I pull out what amazes me it that the Estate agent manager thinks it's OK although I reliase he is working for developer .But will take legal advise soon thanks.

I think you will find he is in order. You can either pull out and get your deposit back or leave it with the developer and hope he doesn’t find another buyer. Tough call either way.

No that's no right as he is saying if I pull out he keeps deposited? So basically it win win for him as he can take viewings and keep me in background to see if I get a buyer or pull out .Which is not right as mentioned the 2k deposit was to hold property without any viewings. He is now not honouring that .

He is now not honouring that . You have not honoured your side of the agreement yet, so he has no reason to reimburse the deposit. You presumably still wish to buy the property? In which case the deposit is a part of the total cost. If you break the agreement (pull out) he keeps the deposit. If he breaks the agreement (sells to someone else) you get the deposit back. Nothing illegal or immoral, just business. This is the nature of deposits.

But my point and the reason I put the 2k deposit down was to stop viewings and have sole deal on buying the property. He in my opinion should either give me some extra time to get a another buyer or refund deposit as I am now no longer the only potential purchaser.He has broken agreement by now showing potential buyers around.He has also put price up so its a different situation. now to when I put deposit down.He is using me as a back up and as I said it's a win win for him .Thanks for your views though
