My mate is looking to get married in his late forties and wants to know where he would stand legally if they divorce. They are both going into it with assets but one is worth a lot more than the other. They are too old for kids so does anyone know what would happen if they say divorced after five years, would their assets just get slit fifty/fifty? Probably a hard question to answer. They don’t want a prenuptial. Cheers

They both have wills which make it clear that their money goes to their own kids. That just leaves the house which was paid for with her money. In theory he is entitled to half as he pays the bills however the deal they have is if she dies first the property goes to her kids but he can live their until he dies and then they can do what they like with it. I think that is a fair settlement she ensures the money she had before they met goes to her family whilst he has a roof over his head.

Uncle of mine had a similar situation, wife's house & he got on with all her kids but, when she died & despite her stating he could stay the kids hounded him out as they wanted to sell & split the proceeds. Grief soon gets engulfed by greed sadly.

I know the original poster said that the couple didnt want a pre nup but as several have said greed & selfishness makes people do really strange things - in my opinion better to bite the bullet, spend a couple hours having it legally documented with both parties signing & then move on with married life

The only way you make a marriage work is to work at making it work. Contemplating the prospect of divorce before you start is perhaps why so many people fail. I married for love to a very kind and gentle girl and we always help each other along, the only caveat is that my wife understands that if for example I cut a piece of timber wrong it is her fault!!!!!!!!!!
