About 5 weeks ago now I was about to play sport when I was running on a rugby field of a sports club (not council run) when I tripped over a V shaped channel that had been dug into the ground about 4 inches deep, 5 inches across and about 4 foot long in total. As far as I can ascertain they had dug it up to lay drainage of some sort, but clearly not filled it in. Where it had been hot the ground was rock hard and my foot got caught in it whilst I was sprinting at full speed. I twisted my knee on it which resulted in: - Fractured knee cap Now I've got private medical so been looked after, and I've already had the first round of surgery to pull my meniscus out my knee cap but I need further ACL reconstruction in about 6 weeks time. I have also lost my holiday to Ibiza which cost £700. Not to mention 2 weeks and counting off work and further down the line when I have round 2 of surgery. What would you do? Accident or negligent. At first I thought its an accident but the more I'm stuck in doors not being able to walk the more I'm getting tempted to file a claim.

I think you've got the basis of a claim there. Actual proof of injury (and serious injury) and clearly they hadn't bordered the area off sufficiently, definite negligence and accident (provided you can prove it).

Actual proof of injury (and serious injury) and clearly they hadn't bordered the area off sufficiently, definite negligence and accident (provided you can prove it). It was on the actual rugby pitch itself not on the sidelines. I have 50+ witnesses including paramedics and registered league officials. I see it as they had a duty of care to provide a safe playing surface and have failed especially given we pay a fee to play there.

Was your holiday not covered by travel insurance? You also saved a fortune by not going, that island seems to hoover the cash straight out your pockets upon landing.

Nah it doesnt cover it I've checked which is a ballache. It was supposed to be a celebration as I just qualified as a chartered accountant as well which is the insult to injury. I may enquire then, just not keen on being hounded 24/7 but them all thats the only problem.
