The Argentine economy seems to struggle almost continually so the possibility to claim this shirt as some sort of National icon (given how much its now known to be worth) would probably be too good an opportunity to pass on without at least making a play for it -

I'm sure, like any club, they wouldn't have been particularly interested in getting it back after the game (there must be a time rule anyway - like the six years you have to pursue a parking fine for example). It is certainly none of Maradona's estate's business. People sell shirts thrown in the crowd all the time so if there is a legal challenge by anyone it will be a non-starter IMO.
