Could we break the transfer window

A request to the more informed members of the forum.

1. The transfer window is a restriction on free movement. Is this not illegal under EU law? Could we challenge this in the courts by signing a striker?

2. What happens after Brexit?

The football family has a history of agreeing rules contrary to employment law e.g. Bosman so it would not surprise me if the transfer window was an illegal restriction.

I hoping someone can clarify.

Thanks Willo the article does seem to suggest the current arrangements are a cosy Stitch up between FIFA and the EU and could be challenged.

You really are clutching at the flimsiest of non-existent straws. If we attempt to sign any player, other than one who was a free agent on or before deadline day, we would be unable to register him and, if we play an unregistered player we will be fined and have points deducted (which we really don't need currently). Plus there's no way our owners would sanction a phenomenally expensive legal challenge that we'd be certain to lose.

We knowingly and wilfully got ourselves into this cack and we can't now start crying about the rules that we signed up to and which apply equally to all of the other clubs.

I concur with these sentiments.

The law is not what it says you may and may not do, the law is what you can get away with. FIFA can get away with this and it helps the big clubs at the expense of smaller ones, so the rest of us are stuck with it. It's bollocks but there's f*** all to be done about it. It's like an unfair tax: you can protest about it, in which case you still have to pay it, or you can refuse to pay it, in which case you get the jile.
