Hi All, Long story short.. My car was parked outside my house. A guy parks his car infront of mine, gets out without putting the handbrake up. As he's walking off his car starts rolling backwards and hits my parked car! (I saw this out of the window). I found my phone and got a photo of his car hitting mine all the damage etc etc etc. I then got a letter from RAC Legal who have said the 3rd party is accepting liability. The lady from Aviva said to me "they will be able to claim your excess back".. My excess is £400.. will the repairing garage (solus - epsom) want me to pay for the damage (up to 400) and then RAC Legal / Aviva will refund me? That's how the lady made it sound. Never been through this process before so any help would be much appreciated as I don't have 400 kicking about lol. Thanks

Yep. Had similar happen in November. Some dopey old bat reversed into the side of me in a car park. I am with Tesco. Had a £300 excess on my policy and also legal cover included. Long story short. Car went into the garage to be resprayed and I was given a courtesy car free of charge for a week. I had to pay the £300 when it was delivered back to me.. 1st March and I am still waiting for it to be settled and paid back. Tesco sent the file over to a legal claims team and they automatically close the case unless YOU peruse them to say you want it dealt with.. it can take up to 18 months i was warned.

18 months is a joke. You can have this back within days from a big insurance company. Similar to energy saving. Save £20 I found or stay with company that answers the phone within a minute without robots who haven't a clue. And some customers have complained some cheap companies claim they miraculously use more energy than the year before and that's with turning the heating down as well.

Strangely enough I'm going through this this week after someone drove into my car on Saturday. Before the repair started the woman's insurance company got in touch. They gave me a hire car and are repairing my car today - I don't need to pay anything! Might it be worth seeing if you can do all this through the 3rd party insurer. It will save you a lot of grief!

I've worked in insurance for 11 years and would give you the following advice. Your policy excess is payable on receipt of any repair work carried out to your vehicle. Your Insurers will settle the repair bill with the chosen garage, less this amount. The £400.00 will then have to be paid, by you, to the garage. The garage will then give you an excess receipt which should be submitted to the third party Insurers as an "uninsured loss". As they have already admitted liability for the cause of this incident, recovering the money back from the party at fault should not be a problem and should be a fairly quick process. If you really do not have the £400.00 payment on hand, it may be worth you approaching your Insurers to see if they will agree to an excess waiver, as they will be able to see from their file that liability is not in dispute with the third party. An excess waiver essentially means that the Insurers will agree to settle the repair bill to the garage in full and recover the full balance from the third party on conclusion of the claim, therefore; not involving you and the excess payment to the garage. I hope this helps in some way.

With an admission of liability, third party Insurers would be keen to refund your money as soon as they possibly can to get rid of you and any future admin work. I'd be complaining after 2-3 months!

Thanks all for the helpful responses. I've not long moved into my new flat so have ploughed a lot of money into it!! Should have thought about this lol!
