Never had more than 3 at a time myself, and have two children now driving, so have been careful to warn them of the reduced points that they can accumulate before a ban, but surely 62 points is well beyond extracting the urine. Shouldn't magistrates be looking at the history and saying enough is enough, regardless of circumstances?

Any magistrates/legal eagles on here that can shed light on why that level of points has been allowed?

This was discussed on Radio 4 this morning and a lawyer, experienced at dealing with motoring cases, said that magistrates exercise discretion where a ban would cause the driver, or a dependent of the driver, undue or extraordinary hardship. As the interviewer pointed out, they must have exercised their discretion quite a few times as you don't get that many points in one go.

It's utterly reprehensible that someone can still be driving with that many points.

If it will cause their family extraordinary hardship then they really should have thought of that the first, second, third, or fourth time they must have been up before the magistrate to defend themselves.

Precisely! That point was made very forcibly in the interview, but was met with the not unexpected lawyerly response of "well it's difficult to comment without knowing the facts of the individual case".

Perhaps a lot of these people driving around with massive points on their licences are Magistrates or members of the legal profession!
