Back problems from Tempur Mattress

Apologies in advance for such a dull post but looking for help. Dug down the back of the sofa and treated myself to a tempur mattress a few months ago from Dreams. Over the last few months it has properly f***ed my back up to the point where it was affecting my work. A big problem as I have quite a physical job. As it took a few months to realise the damage that was being done the "comfort" warranty expired. Initially Dreams customer services told me while their warranty had expired it was within the tempur warranty and said I could have a full refund. They then said they'd made a mistake and it was not covered by the tempur warranty, they could not offer a refund but would offer an exchange for a mattress of equal or more value. Been waiting for 5 weeks and they came to deliver it today to my excitement (been sleeping in my box room on a smaller mattress during which time my back has recovered) but said as the mattress cover was marked (small tea stain which washed off) they would not exchange it and pissed off with my new mattress. The mattress was expensive but they are refusing to take it back despite lengthy and heated conversations with their customer service department. I can't use it. On the grounds of it inflicting severe back pain do I have any way of taking this further? Thanks if anyone can help. Gather Tempurs work well for some people but can cause a lot of discomfort to others.

They offer a generous guarantee to start with TBF.

As a side note a manufacturers new ad campaign is along the lines of 'are you sick of seeing mattress adverts'.

Yes I fcuking am. I got mine from Ikea with the firmness I desire and don't need any overhyped b0llocks even though everyone who sleeps in my bed complains (about the firmness of the memory foam). Their advantage I suppose is that they're a fraction of the cost of Tempur but unbeknown to some customers still the same construction as far cheaper products albeit with marketing which gives the false impression of unique technology.

In short you've been tucked up.

If you have a play about with Google there are so many threads in various places about tempur matresses and people with back problems. The only two things I can suggest assuming there are no legal avenues to explore is trying your best to get rid of r he stain maybe with a spot of bleach or such like and selling it on eBay or a local selling site. Some people swear by them so you may be able to recoup some of the cost to spend on something more suited to you. I believe from a thread I read that ikea do ayou 60 day home approval on their mattesses

Failing that and assuming , quite rightfully, that you want them to remedy the problem after all the faffing about you have had perhaps something public on Twitter , Facebook or some other public forum which can be shared all across the land and shame them into assisting you further

Lol. My older brother went to see him and trying to be down with the kids and show off called him tiny tenbar. Never lived it down since

Thanks for the tips. The annoying thing is the mattress isn't marked underneath the cover they provide though they say the cover is "part of the mattress. Sent them a photo of it unzipped and removed from the mattress to prove it wasn't though they still disagree.

Managed to get hold of the chief executives email, contacted him direct last night and fair play to him he replied to me at 8pm last night, saying the customer service department are following standard procedures and they were unable to be discretionary though he would personally look into it and see if it was possible to find a solution.

Do you have legal expenses insurance added to your home insurance cover.If so, worth a discussion with them.
If not,perhaps a no win no fee legal firm could assist you under the Sale of Goods Act.
