Innocent: This is a very interesting case. The female in the case was subjected to evidence about her previous sexual behaviour. Some people are questioning the rights of this. whatever is the right outcome, it appears that lives have been ruined and will continue to be ruined because of this. How do we find a fair way for rape cases to be heard? The complexities of a rape case are myriad. The right of the accuser and accused have to be respected. A fair and right process needs to be in place but I am not sure that we have the system to do this at the moment. Edited by matt_himself (14 Oct 2016 6.50pm)

I haven't read both the links in full (I will do that shortly and be back to read others comments) but firstly I agree that no one emerges from this sorry story with much in the way of credibility. Secondly there will always be people who subscribe to the stereotype that someone's only the victim of a rape if they are grabbed by A stranger off the street or they are pinned down on a bed whilst screaming no.whilst it doesn't sit comfortably with me a drink girl going into a hotel room with a strange footballer , her past for being somewhat promiscuous doesn't automatically mean that night she wanted sex with whoever happened to waltz into the room . This is a situation which must play out up and down the country on any given evening , a guy goes home with a girl , she's drunk , they do the deed and he could have the police knocking the next day. Hell of a lot of people could fall into that category. It's a very grey , murkey area

Good post. Someone going back to a room under their own steam with someone else - that's informed consent in my book. That doesn't mean consent to anyone else who happens to turn up........ I said with others....quite some time ago that this case would be over-turned. There were quite a few on here very willing for this man's career and life to be completely ruined on very debatable evidence. Ched Evans was clearly an arsehole but the price others were willing to make him pay...on that evidence.... wasn't a positive situation. Edited by Stirlingsays (14 Oct 2016 10.23pm)

Not a rape case but the fact remains if you cannot be sure then you have to go not guilty and acquit. Simple as that. There is too much doubt in this case . I have now read the second link posted and if I were a male in a sexual scenario with a woman saying f**k me harder then I would feel quite within my rights to feel she was a willing participant and therefore consenting .

When drunk you view things differently - things are funny that aren't, bad ideas seem good at the time, this is true to a lot of people. Not all, but a lot. A lot of people get 'horny' when drunk, a lot of people lower their standards, morals included when drunk. Again, not all, but a lot. If she was stone cold sobre, would she have said yes? Would she have said no because she was too embarrassed, not because she didn't want too? Fact is, most of us know that when someone is pissed up, they are more willing to say yes. You don't walk up to a girl in the day and say, wanna have sex? there will be some that yes, but the majority would say no. Fact is, drink gives people regrets, due to them not thinking straight. He should have known better, due to his position in the community and being with someone, but to just turn up and think sex was available is always risky. Also, she should know better - that having a drink changes her perception of things - that she may say yes to stuff she wouldn't normally say yes too. an expensive, painful lesson to both that society will probably ignore and hundreds more get hurt like this.
