Hi, I had an unsatisfactory reference provided while applying for a new job. Can I take my previous employer to the small claims court for 'negligent misstatement'? I am confident I have the evidence to back this up. What kind of compensation would l be entitled to?

Possibly, you should speak either to a solicitor or the CAB. You'll also need to ascertain whether they gave you a bad reference, or just declined to provide a reference.

Unless the law has changed. I was told a number of years ago that it is illegal to write someone a 'bad' reference although that person can refuse to write you one out right. Aren't they a little outdated in any case as I'd guess most employers could check your credentials in other ways. Social Media etc

HR professional here - have you seen the reference? If not you can request it by law. Beat to go to the company that supplied it rather than the one receiving but ask both. Pm me if you need.
